What are you actually acquiring?
A pool villa can look appealing before the contract is understood. Start by asking the seller to identify the proposed right in the document’s original language, its legal basis and what will be registered to you. A brochure’s use of freehold or leasehold does not establish those details.
Bali is part of Indonesia. PP 18/2021, Articles 69 and 71-73, addresses immigration documents, Hak Pakai for individual houses and limitations on price, area, quantity and residential use. Further procedures are assigned to ministerial regulation. The BPK register lists the regulation as in force. This is a starting point, not approval to acquire any advertised villa.
Ask a specialist to match your status and the proposed property to the applicable rules. A proposal to put a right in someone else’s name should not be treated as equivalent to registration in yours. If a company is involved, review its rights, costs and ongoing obligations separately.
Duration and extension terms
Hak Pakai, a right to use, should not be treated as the same thing as a lease merely because the sales translation uses similar wording. Obtain a written explanation of the structure being offered. Identify commencement, expiry, transfer, inheritance and use conditions in the documents.
For a lease, check whether time runs from signing, payment, construction completion or handover. This matters for an unfinished project. “You can extend later” leaves the price and the other party’s obligation unanswered.
| Question | Evidence to request |
|---|---|
| How much time remains? | The commencement and expiry dates |
| What does extension mean? | Conditions, price or formula and the responsible party |
| Can the right be transferred? | Consent requirements, restrictions and charges |
| What happens on expiry? | Terms for the building, improvements and possession |
Do not add potential extensions to the initial term as if the whole period were already secured. Ask your adviser to distinguish documented rights from future negotiations and unconfirmed statements.
Pre-deposit document review
Use three groups of questions. This is an editorial preparation checklist, not an exhaustive legal document list.
Seller and property. Request parcel identification, evidence of the right and the signatory’s authority. Have the documents checked against the parcel, holder and contract, including encumbrances and disputes. Confirm the payment recipient through an agreed process rather than accepting an unfamiliar account in a last-minute message.
Construction and use. Request evidence of the permitted land use and building approvals. If guest rentals are intended, ask which permissions and restrictions apply to the proposed operation. Permission to occupy should not be taken as proof that every commercial rental model is permitted.
Your payment. Read the reservation terms before transferring funds. What is held, for how long, which checks remain and under what circumstances is money refundable? Retain the agreed contract and its attachments. A presentation is not a substitute.
Build a complete villa budget
Separate the cost of getting the property ready from annual ownership or use costs. In the first group, include the proposed right or lease price, documentation, independent review, applicable taxes and charges, furnishing and preparation. Record the source of each figure and who pays it. Leave an unknown cost open rather than entering zero.
For annual costs, examine pool and garden maintenance, repairs, utilities, insurance, management and replacement reserves. For rental projections, ask for available nights, operating expenses and the effect of your own stays. Our Phuket rental calculation demonstrates arithmetic; it is not a Bali market forecast.
Test the location against daily life
Pool photographs do not show the access road or a daily journey. Check access, noise, surroundings, connectivity and routes to the places you will use. Walk the route if walkability is a requirement. Request street and parcel-boundary video rather than interiors alone.
Tourist appeal should not decide a home purchase by itself. Personal use and rental use can require different conditions. Compare a small shortlist with the same questions so that attractive presentations do not hide unanswered essentials.
Prepare an enquiry for IBG Property
Share your purpose, complete budget, funds available now, timing and house requirements. Explain whether you intend to visit or begin remotely. Ask about available proposals and the scope of support for Bali; this page is not an inventory feed. Passports and bank statements are not needed for an initial enquiry. Our buyer starting point helps organise the brief.
Sources and scope
Legal statements were checked on 13 October 2026 against the BPK register and PP 18/2021, Articles 69-73. The preparation checklists and budget structure are original IBG Property editorial guidance. Current ministerial limits, taxes, permissions and transaction documents require separate local review. This is not a legal opinion or individual investment advice.
Frequently asked questions
Is the advertised lease term enough to compare villas?
No. Compare the contract’s subject, transfer conditions, use, costs and expiry provisions as well. Verify extension promises in the documents.
Does paying a deposit mean the documents have been checked?
No. Find out which checks are complete, who performed them and what happens if a problem is found. Refund conditions depend on the contract.
Does this guide contain current villa prices?
No. Price, availability, payments and the scope of support must be confirmed for each proposal.
