Condo, house and land are different questions
“Buy property in Thailand” describes several different transactions. Establish what is actually offered: a separately titled condominium unit, a house, a lease or another contractual right. The marketing word “apartment” does not identify the legal interest you will receive.
The Thai government’s ownership overview distinguishes condominium purchases from restrictions on foreign land ownership. Check rights to a building and its plot separately. Special land-ownership exceptions are not a standard route for buying any villa.
| Property format | Question before shortlisting | Documents to request |
|---|---|---|
| Registered condominium unit | Can the intended right be registered to you? | Property documents and confirmation of quota availability |
| Villa or separate house | What rights are acquired in the building and land? | Land and building documents, and the proposed legal structure |
| Leasehold offer | What term and conditions are actually agreed? | Full contract, registration, assignment and expiry provisions |
If a company, relative or another person is proposed as the owner, do not assume this is equivalent to direct ownership. Obtain independent legal advice on the structure and your rights before accepting obligations.
Understanding the foreign ownership quota
Foreign ownership in a registered condominium is limited to 49% of the total area of its units. This is an area measure, not simply “49 units out of every hundred”. The official condominium guidance sets out the area-based limit. Buyer eligibility is a separate check.
Ask whether the chosen unit can be registered to the proposed buyer under the agreed terms. A general statement that a development offers freehold does not establish availability for your unit at the time of transfer. The contract and payment paperwork should identify the same property and terms.
Decide how you will use the property
For your own home, map everyday journeys: work, school, shops, healthcare and the beach. Look beyond the view to noise, access, shade, ventilation and storage. Visit the surroundings at different times if possible. A location that works for a holiday may not fit a longer stay.
For rental use, identify the likely guest and build an annual calendar. Your own peak-season stays reduce rental availability. Break an operator’s projection into occupied nights, rates, commissions and costs. Our Phuket rental model demonstrates the arithmetic without claiming a market return.
In one supplied IBG Property case, a buyer reconsidered the budget after comparing properties in person. That does not justify recommending a more expensive apartment to everyone. The useful lesson is to discuss why the budget changes and whether future payments remain comfortable. Case studies describe individual outcomes, not promises.
Documents to discuss before a deposit
Create a written checklist with your lawyer. Initial checks normally cover the seller’s identity and authority, property rights, the draft agreement, payment recipient and reservation conditions. An off-plan purchase also raises questions about permissions, completion, specifications and delays. A completed property calls for a condition review, handover arrangements and obligations to building management.
The official registration-document guidance identifies property-title documents and, for a condominium transfer, confirmation of the foreign ownership proportion from the condominium juristic person. The exact pack depends on the parties and transaction. Confirm it with your lawyer and registering authority before transferring money.
“We will check after reservation” is not a completed review, especially where a payment is non-refundable or the contract-review period is short. Ask what happens if the intended registration cannot proceed, the terms change or a discrepancy is discovered.
Funds transfer and FET documentation
The banking process depends on the acquisition basis and the bank’s and registration authority’s requirements. Before sending funds, agree the recipient bank, currency, payment reference, buyer details and the evidence the bank will issue. Do not split transfers or change the recipient simply because someone requests it in a message.
Discuss FET and incoming-funds evidence before payment. A document name in a sales guide is not confirmation from your bank for your circumstances. Obtain a written process and verify payment details through an agreed independent communication channel.
Full cost and payment schedule
The purchase price is not the entire commitment. Budget separately for registration, legal work, banking, furniture, equipment, maintenance and a reserve. Establish what is included, who pays each item and when it falls due. Applicable taxes and charges require a transaction-specific calculation.
Compare instalment plans through dated cash flows rather than the size of the first payment alone. Identify the source of each later payment and test whether a reserve remains if expected income arrives late. The payment-plan brief provides useful preparation questions.
Completed or off-plan
A completed property lets you inspect its actual condition and surroundings. That does not remove the need to review title, outstanding obligations, services and included items. An off-plan purchase needs a separate assessment of delivery, contractual performance and the consequences of delay.
Compare properties on the same basis: area, ownership type, condition, furniture, total commitment and the date you can actually use them. A furnished completed condo and an off-plan starting price without fit-out are not directly comparable.
What you should have before committing
Before the next binding step, you should have an identified property, complete budget, payment schedule, understandable agreement and an open-issues list with owners. A sound purchase starts with knowing what you acquire and how it is recorded, not with pressure to pay today.
For a first enquiry, purpose, budget and timing are enough. Provide identity and financial documents only when the request is justified and a suitable channel agreed. Mention your existing agent if you have one.
Frequently asked questions
Can a foreigner own a condo in their own name?
A unit in a registered condominium can be held by an eligible foreign buyer within the applicable foreign ownership quota. Confirm eligibility and availability for the actual transaction.
Does buying a house include ownership of its land?
Not automatically. Building and land rights must be assessed separately, and foreign land ownership is restricted. Obtain independent legal advice on the proposed structure.
Must I become a partner to buy?
No. Buyers can enquire directly. The partner account is for agents and agencies introducing clients.
